This Privacy Policy explains how MyLoad (Pty) Ltd ("MyLoad", "we", "us") collects, uses, shares, stores, and protects Personal Information and related data when you access or use the MyLoad Platform.

This Privacy Policy applies to all users, including shippers ("Shippers"), transporters ("Transporters"), brokers (where enabled), drivers, and any other person interacting with the MyLoad Platform.

1. Definitions
  • 1.1 "Personal Information" has the meaning assigned in POPIA.
  • 1.2 "POPIA" means the Protection of Personal Information Act, 2013, as amended.
  • 1.3 "Processing" has the meaning assigned in POPIA and includes collection, receipt, recording, organisation, storage, updating, retrieval, consultation, use, dissemination, merging, linking, restriction, erasure, or destruction.
  • 1.4 "MyLoad Platform" means MyLoad proprietary systems, apps, websites, portals, workflows, dashboards, APIs, verification layers, communications, and associated infrastructure.
  • 1.5 "Operator" means a third party who processes Personal Information for MyLoad in terms of a written agreement, including hosting providers, messaging providers, analytics providers, support providers, verification partners, and payment providers.
  • 1.6 "User" means any person who accesses or uses the MyLoad Platform, including Shippers and Transporters.
  • 1.7 "Account" means a User profile created on the MyLoad Platform.
2. Who Is Responsible for Your Personal Information

2.1 MyLoad is responsible for Processing Personal Information that it controls as a responsible party under POPIA.

2.2 Some third parties may process Personal Information as responsible parties in their own right, for example banks, payment providers, insurers, brokers (where opted-in), and government databases. Their processing is governed by their own privacy policies and legal obligations.

3. Information We Collect
3.1 Information you provide directly
  • 3.1.1 Account information: name, business name, registration numbers, VAT numbers, address, email, phone number.
  • 3.1.2 Identity verification: ID numbers, director or member information, CIPC details, proof of address, banking confirmation letters, and related onboarding documents.
  • 3.1.3 Operational information: vehicle details, driver details, licence details, operating areas, equipment, capacity, and availability.
  • 3.1.4 Shipment information: pickup and dropoff areas, load descriptions, weights, dimensions, special handling instructions, and supporting documents.
  • 3.1.5 Communications: messages, emails, call records (where lawfully recorded), support tickets, dispute logs.
3.2 Information collected automatically
  • 3.2.1 Device and usage data: IP address, device identifiers, browser type, OS, app events, pages viewed, session logs, timestamps.
  • 3.2.2 Location data: where enabled, approximate location and route related signals for marketplace integrity and fraud prevention. You can disable precise location, but some features may not function.
3.3 Information from third parties
  • 3.3.1 Verification sources: CIPC, credit bureaus, identity verification services, sanction screening, fraud prevention sources.
  • 3.3.2 Payment and banking sources: confirmations, settlement notices, chargebacks, and risk flags from payment providers.
  • 3.3.3 Insurance sources: policy summaries, schedules, endorsements, and proof of cover where supplied by the Transporter or its broker.
4. Why We Process Personal Information

We process Personal Information for the following purposes:

  • 4.1 To create, verify, and manage Accounts and access control.
  • 4.2 To operate the marketplace, match Shippers and Transporters, and enable quoting, acceptance, and communications.
  • 4.3 To enforce trust and safety, including compliance checks, insurance verification visibility (where applicable), fraud prevention, and platform integrity.
  • 4.4 To enable payments, wallet or clearing logic, reconciliations, and financial reporting.
  • 4.5 To provide support, handle disputes, investigate incidents, and enforce platform rules.
  • 4.6 To communicate updates, legal notices, and platform messages.
  • 4.7 To improve platform performance, analytics, quality control, and product development.
  • 4.8 Where enabled, to facilitate controlled opt-in insurance workflows (including brokers) and enable Users to request or receive insurance related information, subject to explicit opt-in.
5. Legal Basis for Processing

5.1 We process Personal Information on one or more lawful bases under POPIA, including:

  • 5.1.1 with your consent (where required);
  • 5.1.2 to perform or enter into a contract with you (the Terms of Service);
  • 5.1.3 to comply with legal obligations;
  • 5.1.4 for legitimate interests including fraud prevention, risk management, platform safety, and enforcing marketplace integrity.
6. How We Share Information

6.1 We share Personal Information only to the extent necessary for the purposes above.

6.2 Sharing with other Users
  • 6.2.1 Shippers and Transporters share certain information with each other to quote, accept, and complete jobs.
  • 6.2.2 We may limit what is shown until certain milestones occur (for example, acceptance, payment confirmation, or compliance verification).
  • 6.2.3 You acknowledge that once shared with another User as part of a transaction, that User may store it for legal, operational, or accounting reasons.
6.3 Sharing with Operators
  • 6.3.1 We use Operators to provide hosting, communications, verification, analytics, customer support, and other services.
  • 6.3.2 Operators are required to process data only on our instructions and to maintain reasonable security safeguards.
6.4 Sharing for payments
  • 6.4.1 We share necessary data with payment providers and banks to process payments, refunds, settlements, and fraud controls.
6.5 Sharing for legal reasons
  • 6.5.1 We may disclose information where required by law, court order, subpoena, regulatory request, or to protect our rights, Users, or the public.
6.6 Brokers and insurance workflows (where enabled)
  • 6.6.1 MyLoad may enable insurance related workflows, including broker participation.
  • 6.6.2 No Personal Information is shared with a broker unless and until a User has explicitly opted in via the MyLoad Platform or a MyLoad approved process.
  • 6.6.3 Where opt-in occurs, we may share relevant information needed to obtain quotes, evaluate cover, or provide broker services.
7. Data Security

7.1 We implement reasonable technical and organisational measures to protect Personal Information against loss, damage, unlawful access, or unauthorised processing.

7.2 No system is perfectly secure. You accept that online services carry inherent risk and you use the MyLoad Platform at your own risk.

7.3 You are responsible for safeguarding your password, OTPs, and Account access. You must notify us immediately if you suspect unauthorised access.

8. Data Retention

8.1 We retain Personal Information for as long as necessary for the purposes set out in this Privacy Policy, including legal, tax, accounting, dispute, audit, and platform integrity purposes.

8.2 Some information may be retained even after Account closure where required by law or reasonably necessary for legitimate purposes.

9. Your Rights

9.1 Subject to POPIA and applicable law, you may request to:

  • 9.1.1 access your Personal Information;
  • 9.1.2 correct or update inaccurate Personal Information;
  • 9.1.3 delete or restrict processing in limited cases;
  • 9.1.4 object to certain processing;
  • 9.1.5 withdraw consent where processing is based on consent.

9.2 We may require identity verification before fulfilling requests.

9.3 Some requests may be refused or limited where allowed by law, for example where we must keep data for legal compliance, dispute resolution, fraud prevention, or contractual enforcement.

10. Cross-Border Transfers

10.1 We may process or store data in South Africa or other countries depending on our Operators and hosting.

10.2 Where cross-border transfers occur, we take reasonable steps to ensure appropriate protections consistent with POPIA.

11. Direct Marketing

11.1 We may send operational messages that are necessary for the service.

11.2 We will not send direct marketing communications where prohibited by law, and where required we will obtain consent.

11.3 You can opt out of non-essential marketing communications.

12. Children

12.1 The MyLoad Platform is not intended for minors. If you are under 18, you may not create an Account unless legally permitted and supervised by a parent or guardian.

13. Changes to This Privacy Policy

13.1 We may update this Privacy Policy from time to time.

13.2 The updated version will be posted on the MyLoad Platform and will apply from the "Last updated" date.
